Pursuant to Decree 23/2015/ND-CP of the Government and guiding documents:
- Papers and documents that need notarized translation must be originals
- In case the original papers and documents are issued, notarized or certified by a competent foreign agency or organization, they must be consularly legalized in accordance with law; except for cases of exemption from consular legalization under international treaties to which Vietnam is a contracting party or on the principle of reciprocity.
Or if it is an identification document issued by a competent foreign agency or organization to an individual such as: passport, identity card or other papers such as permanent residence card, residence card, driving license, Diplomas, certificates and transcripts attached to diplomas and certificates are not subject to consular legalization.
- The translation is not notarized in the following cases:
+ The original is not authorized or is not valid; fake originals;
+ Papers and documents requested to be translated have been erased, corrected, added, removed or are damaged, old and cannot be clearly identified;
+ Papers and documents requested to be translated are state secrets; papers and documents prohibited from being disseminated according to the provisions of law.
II. Procedures for notarization of translations at Notary Offices
The procedure for notarizing translated documents at the Notary Office is not too complicated. You just need to prepare in advance the original documents, documents need to be translated, notarized.
When you come to the notary office, you present the above documents at the application reception department. After checking the papers and documents, if eligible, the receiving department will schedule a time to return the results; If the dossiers and papers are not eligible, they will return and provide additional instructions and provide qualified records.
