Under the provisions of Article 40 of the Law on Notary 2014, the notaries can notarize the Contract that has been drafted provided that there is no provision in the Contract that violates the law, contrary to social ethics, the object of contracts, transactions are not in accordance with the provisions of law.
However, Article 6 of the Law on Notary 2014 states: "The language and script used in notarization is Vietnamese"
Therefore, when signing a contract for notarization, the language used in the contract must be Vietnamese.
According to Clause 3, Article 47 of the Law on Notary 2014, if the husband of the seller is a foreigner and cannot speak Vietnamese, an interpreter must be required when the two parties make and sign a flat purchase and sale contract at a public agency. proof. Interpreters must fully meet the conditions specified in this Article: Being persons aged full 18 years or older, having full civil act capacity, fluent in Vietnamese and the language that the notarization requester uses use.
