Documentation of inheritance procedures
STEP 1: DECLARATION / DIVISION OF INHERIT LEGAL DIVISION
I. Documents required
ACCEPTANCE DECLARATION / DISTRIBUTION AGREEMENT NOTES
1 + Ownership papers for non-real estate (savings ...)
+ The certificate of home ownership, land use right is legally valid
(with the following types:
- Certificates of land use rights;
- Certificate of house ownership and land use right;
- Certificate of house ownership;
- Certificate of ownership of construction works
- Certificate of land use right, ownership of houses and other land-attached assets)
2 Death certificate of the dead
3 Papers proving that the inheritors / agreement on division of inheritance are the lawful heirs:
- Will (if any);
- Papers proving the inheritance relation according to law (birth certificate, marriage registration, party background, identity card, ...)
4 Identity card / citizen identity card / passport of the declarant / agreement on division of inheritance (Passport, ID card must be clearly not torn, erased and still in use)
5 Household registration book of claimant / inheritor distribution agreement
6 Contract of authorization to sign the receipt / agreement on division of inheritance / donation / sale / transfer (if any)
7 Other relevant documents (if any)
II. Procedure:
- Issue a Notice of acceptance to request for notarization of the inheritance / agreement on division of inheritance and post it at the ward People's Committee where the person leaving the estate has permanent residence before death and the place where there is Real Estate;
- At the end of 15 days, if the People's Committee of a ward / commune confirms that there is no dispute, the notice of the People's Committee of the ward / commune will be sent to the notary office to fill in the procedures for receiving / agreeing to divide inheritance.
STEP 2: Register the inheritance to the heir (Apply for a new Certificate or register a change in the old Certificate) at the Land Registration Office
* Note: Customers can give a copy of the file in advance to the advisors to check eligibility for transactions. But at the time of notarization, the parties must produce all the originals of the above papers for comparison by the Notary Public.
