DECISION:
Article 1. To promulgate together with this Decision the Regulation and price list of land types in Hanoi city, applicable from January 1, 2020 to December 31, 2024.
Article 2. This Decision takes effect from January 1, 2020, replacing Decision No. 96/2014 / QD-UBND dated December 29, 2014 of the City People's Committee on promulgating regulations on prices of Soil type in Hanoi city is applied from January 1, 2015 to December 31, 2019 and Decision No. 19/2017 / QD-UBND dated May 30, 2017 on amending and supplementing regulations. Decision No. 96/2014 / QD-UBND dated December 29, 2014 of the City People's Committee promulgating the regulation on prices of land types in Hanoi city, effective from January 1, 2015 until December 31, 2019.

ON PRICE OF LAND TYPES ON HANOI CITY APPLYED FROM January 1, 2020 to December 31, 2024

Chapter I
GENERAL RULES
Article 1. Scope of application
1. Prices of land types specified in this Decision shall be used as a basis in the following cases:
a) Calculation of land use levy when the State recognizes residential land use rights of households or individuals for an area within the limit; allow the conversion of land use purpose from agricultural land, non-agricultural land other than residential land to residential land for the area within the limit of residential land allocation to households and individuals;
b) Calculating land use tax;
c) Calculation of fees and charges in land management and use;
d) Calculating fines for administrative violations in the field of land;
d) Calculation of compensation money to the State when causing damage in land management and use;
f) Calculation of the value of land use right to pay to the person voluntarily returning the land to the State in case the returned land is land allocated by the State with collection of land use fees, and recognized with the right to use land with payment. using land and leased land with one-off rental payment for the entire lease term;
2. Land prices prescribed in this Decision shall be used as a basis for determining land prices in the following cases:
Calculation of land use levy and land rent in case the State allocates or leases land without going through auction of land use rights, the area in excess of the household's land use right recognition limit , individuals whose area of ​​land use fee, land rent of the parcel of land or valuable land plot (determined according to the price in the Land Price List) is less than VND 30 billion;
Article 2. Interpretation of terms

ON PRICE OF LAND TYPES ON HANOI CITY APPLYED FROM January 1, 2020 to December 31, 2024

Chapter I

GENERAL RULES

 

Article 1. Scope of application

1. Prices of land types specified in this Decision shall be used as a basis in the following cases:

Article 2. Interpretation of terms

5. The State leases land use rights (hereinafter referred to as the State leases land) which is decided by the StateUsing land for subjects having land use demand through land use right lease contracts.

6. Land recovery by the State means the State's decision to revoke land use rights of a person who is assigned land use rights by the State or to recover land from land users in violation of the land law.

7. Land price is the value of land use rights per unit of land area.

8. Public non-business organization means an organization established by a competent state agency, political organization or socio-political organization and functioning to perform public service activities according to regulations. under the law.

9. Economic organizations include enterprises, cooperatives and other economic organizations in accordance with civil law, except for foreign-invested enterprises.

10. Land for construction of underground facilities means land for construction of underground works which are not underground parts of constructions on the ground.

11. Households and individuals directly engaged in agricultural production are households and individuals that have been assigned, leased or recognized agricultural land use rights by the State; receive transfer of agricultural land use rights and have a stable source of income from agricultural production on that land.

Article 3. Principles of determining land position and land price

1. General principles

Based on the profitability and favorable infrastructure conditions for living, business and service provision, the land position is determined on the following principles:

- Position 1 adjacent to the road or street named in the land price list (hereinafter referred to as road (street)) is more profitable and has favorable infrastructure conditions than the next locations.

- Positions 2, 3 and 4 in the order of profitability and infrastructure conditions are less favorable than position 1.

2. Principles for determining the location and price of non-agricultural land

2.1. Principles of determining land location:

- Position 1: applies to a land plot of an owner with at least one side (face) adjacent to the road (street) named in the price list issued together with this Decision;

- Position 2: applies to a land plot of an owner with at least one side (side) adjacent to alleys, alleys and alleys (hereinafter collectively referred to as alleys) with the smallest lane cross-section (from the boundary) sidewalk (street) named in the price list of land to the first landmark of the parcel of land adjacent to the lane) of 3.5 m or more.

- Position 3: applies to a land plot of an owner with at least one side (face) adjacent to the lane with the smallest lane cross-section (from the pavement boundary (street) named in the next land price list). The first landmark of the parcel of land adjacent to the alley) is from 2 m to less than 3.5 m.

- Position 4: applies to a land plot of an owner having at least one side (face) adjacent to the lane with the smallest lane cross-section (from the pavement boundary (street) named in the next land price list). the first landmark of the parcel of land adjacent to the alley) is less than 2 m.

2.2. Rules for determining land prices for special cases:

a) For land parcels with sides (edges) adjacent to two streets (streets) or more, the land price is multiplied by the following coefficient:

- A parcel of land with at least 4 sides (faces) adjacent to a road (street) named in the Land Price List shall be multiplied by the coefficient K = 1.3 of the road with the highest land price.

- For a parcel of land with three sides (sides) adjacent to a road (street) named in the Land Price List, multiplied by K = 1.25 of the road (street) with the highest land price.

- A parcel of land with two sides (sides) adjacent to a road (street) named in the Land Price List shall be multiplied by the coefficient K = 1.2 of the road (street) with the highest land price.

- Land parcel with one side (face) adjacent to the road (street) named in the Land Price List and at least one other side (face) adjacent to the lane (with the smallest lane section of 3.5 m or more (calculated from the pavement boundary (street) named in the land price list to the first landmark of the land lot adjacent to the lane)) is multiplied by the coefficient K = 1.15 of the street (street) named in the price list land.

- A parcel of land has one side (face) adjacent to the road (street) named in the Land Price List and has at least one other side (face) adjacent to the lane (with the smallest lane section from 2 m to under 3, 5 m (from the boundary of the road (street) named in the land price list to the first landmark of the parcel of land adjacent to the lane)) is multiplied by the coefficient K = 1.1 of the named street (street). in the Land Price List.

The land price after applying K coefficient must not exceed the maximum price bracket of the same type of land stipulated by the Government; in case of exceeding, it is equal to the Government's land price bracket.

b) For land plots of a land user at positions 2, 3 and 4 of Tables 5 and 6 (except Tay Dang town of Ba Vi district) and Table 7 of old residential areas (Not located in a new urban area, auction area, resettlement area, industrial complex or industrial park) if there is a distance along the existing road from the first boundary of the land plot to the street (street) named in price list ≥ 200m, the land price is reduced as follows:

- Distance from 200 m to 300 m: a 5% reduction from the prescribed land price.

- Distance from 300 m to 400 m: 10% reduction against the prescribed land price.

- Distance from 400 m to 500 m: a 15% reduction compared to the prescribed land price.

- Distance from 500 m or more: 20% lower than the prescribed land price.

c) For a land plot owned by one owner at positions 2 and location 3 and position 4 have a connecting road with many roads (streets), the land price is calculated according to the position of the road (street) (highest) (Taking into account the deduction factor at Point b if any);

d) For a land plot of an owner whose side (face) is adjacent to roads, streets or alleys with the depth of the parcel of land from the boundary of pavements, streets and alleys> 100 m divided into grade for calculation of land price as after:

- Grade 1: Calculated from 100% of the prescribed land price from the pavement, street and lane boundaries.

- Grade 2: Calculated from the boundary of pavements, streets and alleys from over 100 m to 200 m, 10% lower than the land price of grade 1.

- Grade 3: Calculating from the boundary of pavements, streets, alleys from over 200 m to 300 m down 20% compared to the price of land of grade 1.

- Grade 4: Calculated from the boundary of pavements, streets and alleys from over 300 m down 30% compared to the price of land of grade 1.

d) In case a parcel of land of a land user with a particular shape, is obscured (L-shaped, T-shaped ...) with (adjacent) adjacent to roads, streets and alleys, the contiguous area For roads, streets and alleys, counting from the front to the depth of the land parcel, the land price is calculated according to the positions and purposes prescribed in Articles 4, 5, 6, 7, 8 and 9, Chapter II of this Regulation. ; For the remainder of the land area, the coefficient K is applied as follows:

- The land parcel (land area) is located at 1: K = 0.9 of the land price as prescribed.

- The land parcel (land area) is located at position 2: K = 0.8 of the land price as prescribed.

- The land parcel (land area) is located at position 3, position 4: K = 0.7 of the land price as prescribed.

e) For land plots with location 1, position 2 and position 3: The average land price of the whole land parcel after applying K coefficient or classifying at Points d and d must not be lower than the land price of lower position adjacent to the road, street, and contiguous lane of the land plot; In the lower case, it is the price of land of the adjacent lower position.

g) In the case of parcels of land within administrative boundaries of communes, interspersed with parcels of land at traffic axes belonging to the administrative boundaries of towns and areas adjacent to urban districts; or on the same roadway on one side of the commune, on the other side is the administrative boundary of the town, adjacent to inner city district, the price is determined according to the location with the highest price; principles of determining locations and prices of these cases comply with the provisions of the above-mentioned Points and Article 6, Chapter II of this Regulation.

h) The price of land on new roads (streets) not included in the price list issued together with this regulation is determined according to the principles in Clauses 1 and 2 of this Article and corresponding to the land price of the road ( street) has an equivalent name in the area.

3. The boundaries of roads and streets specified in Clauses 1 and 2 of this Article are applied as follows:

a) In the case of a parcel of land which is allocated or leased by the State, the boundary of the road (street) shall be calculated according to the existing road boundary according to the 1/500 plan of the approved parcel of land.

b) In cases where a land parcel is assigned or leased by the State, which is carried out in different stages, the pavement line (street) shall be calculated according to the existing road boundary line corresponding to the planning of a scale of 1 / 500 of the parcel of land approved.

c) In other cases, the pavement line (street) indicated in the price list shall be calculated according to the current pavement (street) boundary.

4. The prices of commercial land, services and non-agricultural production and business land which are not commercial or service land in the Land Price List are calculated corresponding to the land use term of 70 years.

chapter II

LAND PRICE PRICE

 

Article 4. Agricultural land prices

1. Prices of agricultural land for rice and other annual crops, land for planting perennial trees, aquaculture land, production forests, protection forests and special-use forests in communes in districts are determined According to the purpose of use when assigned, leased and classified by region, region (delta region, midland, mountainous region) specified in Table 1, Table 2, Table 3, Table 4 and Appendix of classification Commune.

2. The price of agricultural land within a residential area of ​​a town or rural residential area has been determined with a boundary according to the planning approved by a competent state agency (in case there is no approved planning, determined according to the boundaries of the land plot with houses in the outer residential area), the higher price may be determined, but does not exceed 50% of the corresponding agricultural land price specified in Tables 1, 2, 3 and 4. and Annex of commune classification.

3. Other agricultural land prices (including land in suburban communes used to build greenhouses and other types of houses for cultivation purposes, including forms of cultivation not directly on land; construction of cages raising cattle, poultry and other animals permitted by law; arable land, livestock, aquaculture for study and research purposes; nursery land for breeding seedlings, breeding animals and Land for ornamental flowers) is determined by the price of agricultural land for perennial crops of the same area or region specified in Table 2 and the commune classification Appendix.

Article 5. Prices of residential land, commercial land, services and non-agricultural production and business land which are not commercial or service land in urban areas

1. In urban districts and wards of Son Tay town; Towns in districts, land prices are determined according to Article 3 of this Regulation, specific prices for each street, street and each location are specified in Table 5 (for districts and wards of Son Town). West); Table 6 (for towns within districts).

2. In Vien Son, Trung Hung and Trung Son Tram wards in Son Tay town, Chuc Son town in Chuong My district and Tay Dang town in Ba Vi district, land prices are determined according to Article 6 of This provision.

Article 6.- Prices of residential land, commercial land, services and non-agricultural production and business land which are not commercial and service land in rural areas (including areas adjacent to urban centers and areas along roads main and rural communes)

1. Prices of residential land, commercial land, services and non-agricultural production and business are not commercial and service land in communes and towns bordering districts (bordering administrative boundaries with districts) are identified for each street and street specified in Table 7 and the Annex to classify communes.

2. Prices of residential land, commercial land, services and non-agricultural production and business land are not commercial and service land in areas along the main traffic hub named in the price list of districts; Vien Son, Trung Hung and Trung Son Tram wards, Son Tay town (specified in Table 8) and Tay Dang town and Ba Vi district (specified in Table 6) are specified for each road. city.

3. Prices of residential land, commercial land, services and non-agricultural production and business land which are not commercial and service land in rural areas are specified by each commune in Table 9 applicable to residential areas belonging to Tay Dang communes and towns, Ba Vi district are outside the 200m range of the named streets specified in Table 8, Tay Dang towns are specified in Table 6. For the land plot of one owner At positions 2, 3 and 4 of Table 8 and Tay Dang town specified in Table 6 are determined as follows:

- Within the range from the pavement boundary (street) named in the land price list to 200 m, it is determined on the principle of 4 positions specified at Point 2.1, Clause 2, Article 3;

- In addition to 200 m from the pavement boundary, roads (streets) that are named in the price list shall apply the price of land in rural residential areas specified in Table 9.

4. A land plot owned by a user at position 4 specified in Table 7 is specifically determined as follows:

- Within the range from the pavement boundary (street) named in the price list to 200 m determined according to position 4;

- In addition to 200 m from the pavement boundary (street) named in the price list, the price shall be determined according to the specific provisions in Table 7.

5. The land plot of the user is located at position 4 specified in Table 8; Vien Son, Trung Hung and Trung Son Tram wards and Son Tay town, defined in Table 5 and Tay Dang town of Ba Vi district, are specified in Table 6 as follows:

- Within the range from the pavement boundary (street) named in the price list to 200 m determined according to position 4;

- In addition to 200 m from the pavement boundary (street) named in the price list, the price shall be determined according to the specific provisions in Table 9.

6. Cases of land allocation or lease by the State in rural residential areas: production and business, industrial clusters, industrial parks, new urban centers, auction areas, resettlement areas connected to the road named in the price list, based on the current road to apply the land price according to 4 locations of the nearest street and street named in the price list and dry. The price of rural residential land price is not applied as specified in Table 9.

Article 7.- Land prices in new urban areas, auction areas, resettlement areas and hi-tech parks (already built of roads)

1. In cases where the parcel of land is not located within the boundaries of new urban areas, auction areas, resettlement areas but is located adjacent to or has roads and alleys closer to roads and streets of new urban centers, areas auction, resettlement area is determined according to the land prices of roads, streets in new urban areas, auction areas, resettlement areas; In cases where the land parcel is located at positions 2, 3 and 4, it shall be determined by the road (street) in the area with the equivalent price level with the prescribed land price for the positions.

Article 8. Other non-agricultural land prices

1. Residential land is classified according to Section 2.1; 2.2.1; 2.2.2; 2.2.3; 2.2.4.8 Appendix 1 issued together with Circular 27/2018 / TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources and Environment.

2. Non-agricultural production and business land that is not commercial or service land: is classified under Section 2.2.5.1; 2.2.5.2; 2.2.5.3; 2.2.5.5; 2.2.6.5; 2.2.6.10; 2.3; 2.4; 2.8 Appendix 1 issued together with Circular 27/2018 / TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources and Environment.

3. Commercial and service land: classified according to Section 2.2, Appendix 1 issued together with Circular 27/2018 / TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources and Environment (Excluding Items mentioned in Clause 1 and Clause 2 in this Article)

4. Land prices used for cemeteries, graveyards, funeral parlors and cremation houses (prescribed in Section 2.5, Appendix 1 issued together with Circular 27/2018 / TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources) and Environment): comply with the Land Law 2013. The City People's Committee will determine by the price of land for non-agricultural production and business land other than commercial land, services of the same location, road. , streets, rural residential areas.

5. Land prices of rivers, canals, canals, streams and specialized water surfaces used for aquaculture purposes (prescribed in Section 2.6; 2.7 Appendix 1 issued together with Circular 27/2018 / TT- MONRE dated December 14, 2018 of the Ministry of Natural Resources and Environment) is determined by the price of aquaculture land of the same area and the same region; use for non-agricultural purposes or non-agricultural purposes in combination with aquaculture is determined by the price of non-agricultural land other than commercial and service land with the same use purpose. , location, road, street, type of commune.

For specific projects not classified under Section 2, Appendix 1 issued with Circular 27/2018 / TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources and Environment, the City People's Committee will be determined. Land prices are specific in each case.

Article 9. Unused land prices

Unused land means land that has not been put to use for purposes prescribed by the Land Law, including unused flat land, unused hilly land, rocky mountains without forests, when price is needed. In order to calculate the compensation for the person who violates the law for this type of land, the price of the adjacent land with the highest price (based on two or more different types of land) shall be based on the price of the adjacent land type. Land price determination. When the unused land is allowed to be put into use by competent agencies, the land price of the same type and the same use purpose prescribed in this Regulation shall be based on the specific price norm.

Chapter III

Article 10. Organization of implementation

For areas not yet determined in the price list, the Appendix enclosed herewith or new cases arising due to the construction of roads, new urban areas, auction areas, resettlement areas, areas industry and hi-tech zone assigns Department of Natural Resources and Environment to preside over departments, branches and People's Committees of districts, towns and townships to make price plans and report to the City People's Committee for decision.

Department of Natural Resources and Environment is responsible for periodically updating land price fluctuations in the area as a basis for making a plan to submit to the City People's Committee for promulgating the land price list once every 5 years and announcing it. on January 1 of the first year of the period; summarize and adjust the land prices annually according to regulations and submit them to the City People's Committee for consultation with the Standing Committee of the City People's Council before adjusting the land price list.

Chairpersons of People's Committees of rural districts, urban districts and towns shall direct Natural Resources and Environment Divisions to monitor and update land price fluctuations in their localities and promptly report to provincial-level Natural Resources and Environment Departments for total well suited.

Article 11. Amendments and supplements

In the course of implementation, if any problem arises, the Department of Natural Resources and Environment shall have to sum up and submit it to the City People's Committee for consideration and decision.
