1. Process and records for temporary registrants
According to Article 16 of Circular 35/2014 / TT-BCA, the application for temporary residence registration includes:
- Demographic declaration form
- A notice of household registration or demographic change
- Papers proving lawful domicile (except where the head of household has a household registration book or temporary residence book agrees to the temporary residence, there is no need to produce documents about the residence)
For cases of renting, borrowing or staying at lawful domicile places, when registering temporary residence, there must be consents to the temporary registration of the lessees, lenders or permitted to stay at the notices on change of household registration or personal password, sign and specify full name, day, month and year
- People's identity card or written certification of the commune, ward or town authority of the permanent residence
The time limit for processing temporary residence registration and granting temporary residence books is 02 days from the date of receiving complete dossiers.
2. 5 cases of name deletion are registered in temporary residence registers
The following cases will be temporarily removed from temporary residence according to Article 19 of Circular 35 / 2015.TT-BCA:
Police of wards, communes or townships where temporary registrants are registered must delete their names in temporary residence registers in the following cases:
- People who have registered temporary residence but died, missing
- Persons who have registered temporary residence but do not live, work, labor or study in localities that have registered temporary residence for 06 months or more
- Persons who have registered their temporary residence but whose temporary residence duration has expired for 30 days but fail to go to the police office where they register their temporary residence for carrying out procedures for extending their temporary residence.
- Persons who have registered temporary residence but are registered with permanent residence
- The person who has registered for temporary residence but has been decided by the competent police to cancel the temporary residence registration as prescribed in Clause 1, Article 20 of this Circular.
3. The fine level for failing to register temporary residence
According to Article 8 of Decree 167/2013 / ND-CP, violations of regulations on residence registration and management will be subject to the following penalties:
- A fine of from 100,000 to 300,000 VND: Individuals, household heads that fail to comply with regulations on permanent residence registration, temporary residence registration or adjustment of changes in household registration books, temporary residence books;
- A fine of from 1 to 2 million VND: Erasing, erasing, modifying or committing other acts to falsify the contents of the household registration book, temporary residence book or other papers related to residence;
- A fine of from 2 to 4 million dong: Making false statements, forging documents and papers to register permanent residence, temporary residence, issue household registration book, temporary residence book; Letting another person register his / her residence in his / her place for self-seeking or in fact the applicant does not live there ...
Accordingly, individuals and household heads who do not register their temporary residence will be fined 100,000 - 300,000 VND.
