Adoption has become very popular in today's society. Persons who want to adopt a child must complete all compulsory procedures according to the current regulations of Vietnam. Please keep in mind the following procedures in order to proceed with adoption conveniently and legally.

I. Adoption conditions
The adopting person must meet the conditions specified in Article 14 of the Adoption Law 2010 as follows:
- Having full civil act capacity;
- More than 20 years older than the adopted child;
- Having good health, economy, and accommodation to ensure adoption, nurturing and education;
- Having good moral character.
The following people are not allowed to adopt children:
- Being restricted from a number of parents' rights over minor children;
- Being complying with decisions on administrative handling at educational establishments and medical treatment establishments;
- Being serving a prison sentence;
- The criminal record of one of the crimes intentionally infringes on the life, health, dignity and honor of another person has not been removed; mistreating or abusing grandparents, parents, spouses, children, grandchildren or people with meritorious services to nurture themselves; seducing, forcing or harboring young people who violate the law; trading, fraudulently exchanging and appropriating children.
In case a stepfather adopts a stepchild from his wife, stepmother adopts stepchild, or aunts, uncles, aunts and uncles adopt nephews, the condition shall not apply to those who are at least 20 years old or older. and conditions on health, economy and accommodation to ensure the care, nurture and education of adopted children;
II. The person to be adopted
Article 8 of the Adoption Law 2010 provides:
- Children under 16 years old
- Persons aged between full 16 and under 18 in one of the following cases:
a) Being adopted by his stepfather, stepmother;
b) Adopted by an aunt, uncle, aunt, uncle.
- A person may only be adopted by a single person or both of them being husband and wife.
The State encourages the adoption of orphans, abandoned children and children in other special circumstances for adoption.
III. Adoption procedure
Dossiers of adopting persons specified in Article 17 of the Adoption Law include:
1. An application for adoption;
2. Copy of Passport, Identity Card or valuable substitute paper;
3. Judicial record card;
4. Documents certifying marital status;
5. Health certificate issued by the district health agency or higher; a document certifying family circumstances, housing status, and economic conditions issued by the commune-level People's Committee of the locality where the adopting child permanently resides, except where the step-father adopts stepchild from step-father and step-child adopts step-child The husband of an adopted child or aunt, uncle, aunt who adopts the grandchild.
A dossier of a domestic adopted child includes:
- Birth certificate;
- Health certificate issued by the district health agency or higher;
- Two full body photos, taken within 06 months straight;
- A written certification made by the People's Committee or the Commune-level Police where the child is found abandoned for the abandoned child; The death certificate of the natural father or mother or a court decision declaring the father or mother of a child dead for orphaned children; The court's decision to declare the biological father or mother of the person being introduced for adoption is missing for the person introduced to be adopted and the father and mother are missing; The court's decision to declare that the natural father or mother of a person who is being adopted is incapable of civil acts against the person who is introduced to be adopted and the father and mother lose civil act capacity;
- Admission decision for children in foster facilities.
The biological parents or guardians compile dossiers of the adopted children who live at home; Child rearing establishments shall make records of children who are introduced for adoption and live in the rearing establishments.
 The adopting person must submit his / her own application file and the dossier of the adopted child at the People's Committee of the commune where the person introduced to be adopted permanently resides or where the adopting person permanently resides.
The time limit for settling a child adoption is 30 days, counting from the date the commune-level People's Committee receives a complete and valid dossier.
IV. Adoption procedures at Dai Viet Law
